THE RIGHT TO BE FORGOTTEN IN DATA PROTECTION LAW AND TWO WESTERN CULTURES OF PRIVACY

Abstract Data protection law has emerged as an important bulwark against online privacy intrusions, and yet its status within remains awkward. Its starting point of protecting ‘personal’ rather than ‘private’ information puts it at odds with more generally. Indeed, in very design, data caters for the public personal information, or which attained a degree publicness through disclosure. Building on James Whitman's comparative study, this article argues that is not odd bedfellow properly so called but may be understood manifestation Continental European culture privacy. distinctiveness does lie apparent technicality robust openness to public—an idea alien Anglo-American Whilst these two cultures have long ‘met’ different jurisdictions, locates their enduring influence antagonism three contemporary regimes. By taking right forgotten, archetypal privacy-in-public right, testing context spent criminal convictions, gauges such claims, first, Court Justice Union authoritative voice General Protection Regulation normativity; secondly, US judiciary committed First Fourth Amendment; and, thirdly, Human Rights Article 8 Convention fused jurisprudence. It latter jurisprudence particular highlights tensions arising from trying marry traditions, merge ‘privacy’ law. Yet, also offer insights opportunities.
